Right to a Fair Hearing


IF YOU HAVE BEEN DENIED SERVICES BY COMMUNITY ACTION YOU HAVE THE RIGHT TO A HEARING BEFORE THE EXECUTIVE DIRECTOR OR A PERSON APPOINTED BY THE EXECUTIVE DIRECTOR.
IF YOU WANT A HEARING, YOU MUST SUBMIT YOUR WRITTEN REQUEST WITHIN 10 DAYS FROM THE DATE OF THE DENIAL OF YOUR SERVICES. HEARING FORMS ARE AVAILABLE AT THE RECEPTION DESK.


The hearing is informal. At the hearing, you have the following specific rights to:
1. Have a representative at the hearing;
2. Present notarized written and oral statements and other evidence;
3. Bring witnesses and cross examine;
4. Bring an interpreter or have one provided.


CERTAIN PROGRAMS HAVE THEIR OWN HEARING PROCESS WHICH MAY DIFFER FROM THE STANDARD COMMUNITY ACTION PROCEDURE, FOR EXAMPLE, THE LOW-INCOME ENERGY ASSISTANCE PROGRAM [LIEAP].


HEARING REQUEST FORMS AND THE STANDARD HEARING PROCEDURES ARE AVAILABLE IN THE HUMAN RESOURCES DEPARTMENT UPON YOUR REQUEST AS AN APPLICANT WHO HAS BEEN DENIED SERVICES.
